PUBLIC OFFER

(Public offer for concluding a contract)

1. General Provisions

This document is an official offer (public offer) from the company:

Suzhou McKathy Fluid Technology Co., Ltd.
(hereinafter — "Seller")

in accordance with Article 437 of the Civil Code of the Russian Federation.

By placing an order on the website, the Buyer confirms that they have:

  • read the terms of this offer
  • fully accepted its terms
  • undertaken to comply with them

2. Subject of the Contract

The Seller undertakes to supply industrial products (pumps and components), and the Buyer undertakes to accept and pay for the goods.

3. Product Nature

The Seller's products:

  • can be standard or custom-made
  • can be manufactured according to the Buyer's technical specifications, drawings, or requirements

The Buyer agrees that:

✔ goods may be custom-made
✔ such goods may not be returnable

The final characteristics of the products are determined by:

  • technical specifications
  • commercial offer
  • order confirmation

4. Order Placement

An order is considered accepted only after:

  • confirmation by the Seller
  • agreement on technical parameters
  • receipt of payment (if applicable)

The Seller has the right to refuse to fulfill an order without explanation.

5. Price and Payment

  • Prices on the website are indicative
  • The final cost is agreed upon individually
  • Payment is made according to the issued invoice

Production of goods may begin only after:

✔ order confirmation
✔ receipt of payment

6. RETURN CONDITIONS AND LIMITATIONS

6.1 Mandatory Prior Agreement

⚠️ Any return is possible only after prior agreement with the Seller.

The Buyer is obliged to:

  • send a request by email
  • state the reason for the return
  • provide photos/videos

Returns without prior agreement will not be accepted.

6.2 Return of Goods of Proper Quality

The Buyer has the right to request a return within:

✔ 7 calendar days

provided that the following conditions are met:

  • the goods have not been used
  • have not been installed
  • the packaging is preserved
  • the completeness is preserved

The Seller has the right to refuse if the conditions are not met.

6.3 Return Restrictions

Returns are not accepted if:

  • the goods are custom-made
  • the goods were produced according to the Buyer's technical specifications or drawings
  • the goods have individual characteristics
  • the goods have been used or installed
  • the goods are damaged due to the Buyer's fault
  • the packaging is missing

6.4 Non-Returnable Goods

The following are not returnable:

  • individually manufactured goods
  • products for a specific project
  • non-standard items

6.5 Goods of Improper Quality

In the event of a confirmed defect, the Buyer has the right to demand:

  • repair
  • replacement
  • refund (full or partial)

The decision is made after inspection by the Seller.

6.6 Return Costs

  • if no defect — at the Buyer's expense
  • if confirmed defect — at the Seller's expense

6.7 Final Decision

The decision on:

  • return
  • replacement
  • compensation

is made by the Seller based on the inspection.

7. ORDER CANCELLATION AND START OF PRODUCTION

After production begins:

✔ the order is considered individual

In case of order cancellation by the Buyer:

The Seller has the right to retain actual costs incurred, including:

  • cost of materials
  • production costs
  • pre-production expenses

The remaining amount is subject to refund (if applicable).

If expenses are equal to or exceed the payment:

✔ no refund will be issued

Cancellation is possible only after agreement with the Seller.

8. Delivery

  • is carried out by agreement
  • delivery times are indicative

The risk of loss or damage to the goods passes to the Buyer:

✔ upon transfer to the first carrier

9. Liability

The Seller is not responsible for:

  • improper use of the goods
  • errors in the Buyer's technical specifications
  • failure to meet expectations while adhering to technical specifications

10. Force Majeure

The parties are exempt from liability in cases of:

  • natural disasters
  • military actions
  • government restrictions
  • logistics failures

11. Governing Law

This offer is governed by the laws of the Russian Federation.

13. Concluding Provisions
